Movie-camera maker accuses rival of corporate espionage (Reuters)

LOS ANGELES (TheWrap.com) ? Shots are being fired in the world of the digital camera.

California-based Red Digital Cinema alleges that a former executive at Delaware-based Arri engaged in corporate espionage when he hacked into the email server of a third camera company, according to a complaint Red filed December 21 in U.S. District Court in California.

According to the lawsuit, which was obtained by TheWrap, Red alleges Arri used the hacked emails to give its Alexa camera a competitive advantage over Red's Epic camera.

Red alleges unfair competition based on email hacking, invasion of privacy, conversion, misappropriation of trade secrets and unlawful trade practices, among other charges.

In September, Michael Bravin, Arri's ex-VP of market development for digital camera products, pleaded guilty to unlawfully accessing the email server of Band Pro Film & Digital while he was employed at Arri.

Bravin, who had previously worked for Band Pro, was charged with computer fraud and email hacking and, following a plea agreement, was sentenced to two years' probation, among other penalties.

Now, Red says some of the emails Bravin copied had sensitive information about the company's technology, including the Epic camera. Some of the emails were from Red personnel including founder Jim Jannard, Red also alleges.

At the time of the hacking, Red was allegedly in confidential business discussions with Band Pro, discussing a potential joint venture. Arri employees -- including Chief Technology Officer Glenn Kennel and Vice President of Camera Products Bill Russell -- were aware Bravin was engaging in the hacking, Red says. Therefore, Arri is liable, according to Red.

"Red is informed and believes, and thereupon alleges, that Bravin saved or forwarded, either directly or verbally, the information obtained from the Band Pro emails to other Arri executives and employees," the suit says.

Additionally, Red alleges that Arri started a false advertising campaign leading up to the launch of the Alexa camera, and that Bravin -- using his real name and a pseudonym -- posted on a Red blog, RedUser.net, disparaging the company's products. Red says one of the Web-blog board's policies is that users do not use false names.

Red is seeking damages, disgorgement, restitution and injunctive relief. The company is seeking a jury trial.

"It was quite shocking to them, that the vice president of Arri would steal business emails for use at Arri," lawyer Gregory L. Weeks, who represents Red, told TheWrap.

A representative for Arri did not respond to TheWrap's request for comment.

Movies including "The Hobbit," "Prometheus" and "The Girl with the Dragon Tattoo" were shot with Red cameras.

"Hugo," "Pariah" and "New Year's Eve" were shot with Arri cameras.

STOCKHOLM ? Sweden's royal family says a book that accused the king of visiting strip clubs and media reports that claimed the queen was on the verge of a nervous breakdown made 2011 a very tough year.

But the family also says the onslaught brought it closer together.

In a series of interviews conducted by national broadcaster SVT, to be aired later Thursday, the family says the book "The Reluctant Monarch" triggered an unprecedented media siege that has hurt all of its members.

Queen Silvia says headlines claiming she was close to a breakdown have been "incredibly painful," making her "disappointed and sad."

Crown Princess Victoria describes 2011 as "a very tough year" for the family.

12 must-see skywatching events in 2012

As the year 2011 comes to a close, some might wonder what is looming sky-wise for 2012? What celestial events might we look forward to seeing??

I've selected what I consider to be the top 12 "skylights" for this coming year, and list them here in chronological order. Not all these events will be visible from any one locality ... for the eclipses, for instance, you'll probably have to do some traveling ... but many can be observed from the comfort of your backyard.

Hopefully your local weather will cooperate on most, if not all, of these dates. Clear skies!

Jan. 4: Quadrantid meteor shower peaks
This meteor shower reaches its peak in the predawn hours of Jan. 4 for eastern North America. The Quadrantid meteor shower is a very short-lived meteor display, whose peak rates only last several hours. The phase of the moon is a bright waxing gibbous, normally prohibitive for viewing any meteor shower, but the moon will set by 3 a.m., leaving the sky dark for a few hours until the first light of dawn; that's when you'll have the best shot at seeing many of these bluish-hued meteors.?

From the eastern half of North America, a single observer might count on seeing as many as 50 to 100 "Quads" in a single hour. From the western half of the continent the display will be on the wane by the time the moon sets, with hourly rates probably diminishing to around 25 to 50 meteors.

Feb. 20 to March 12: Best evening apparition of Mercury
In February and March, the "elusive" innermost planet Mercury moves far enough from the glare of the sun to be readily visible soon after sunset. Its appearance will be augmented by two other bright planets (Venus and Jupiter), which also will be visible in the western sky during this same time frame.

Mercury will arrive at its greatest elongation from the sun March 5. It will be quite bright (-1.3 to zero magnitude) before this date and will fade rapidly to +1.6 magnitude thereafter. Astronomers measure the brightness of objects in terms of magnitude, with lower numbers corresponding to brighter objects.

March 3: Mars arrives at opposition
On March 3, Earth will be passing Mars as the two planets wheel around the sun in their respective orbits. Because Mars reaches aphelion ? its farthest point from the sun ? on Feb. 15, this particular opposition will be an unfavorable one. In fact, two days after opposition, Mars will be closest to Earth at a distance of 62.6 million miles.

Compare this with the August 2003 opposition when Mars was only 34.6 million miles away.? Nonetheless, even at this unfavorable opposition the fiery-hued Mars will be an imposing naked-eye sight, shining at magnitude -1.2, just a bit dimmer than Sirius, the brightest star, and will be visible in the sky all night long. ? ?

March 13: Brilliant 'double planet'
The two brightest planets, Venus and Jupiter, team up to make for an eye-catching sight in the western sky soon after sunset. They will be separated by 3 degrees on this evening, Venus passing to the northwest (upper right) of Jupiter and shining nearly eight times brighter than "Big Jupe." Although they will gradually go their separate ways after this date, on March 25 and 26, a crescent moon will pass by, adding additional beauty to this celestial scene.

May 5: Biggest full moon of 2012
The moon turns full at 11:35 p.m. ET, and just 25 minutes later it will arrive at its closest point to Earth in 2012, at a distance of 221,801 miles. Expect a large range in ocean tides (exceptionally low to exceptionally high) for the next few days. [Photos: 'Supermoon' of 2011]

May 20: Annular eclipse of the sun
The path of annularity for this eclipse starts over eastern China and sweeps northeast across southern and central Japan. The path continues northeast then east, passing just south of Alaska's Aleutian Island chain. The path then turns to the southeast, making landfall in the western United States along the California-Oregon coast. It will pass over central Nevada, southern Utah, northern Arizona, the extreme southwest corner of Colorado and most of New Mexico before coming to an end over northern Texas.

Since the disk of the moon will appear smaller than the disk of the sun, it will create a "penny on nickel" effect, with a fiery ring of sunlight shining around the moon's dark silhouette. Locations that will witness this eerie sight include Eureka and Reading, Calif.; Carson City, Reno and Ely, Nev.; Bryce Canyon in Utah; Arizona's Grand Canyon; Albuquerque and Santa Fe in N.M., and just prior to sunset for Lubbock, Tex.

A partial eclipse of the sun will be visible over a large swath of the United States and Canada, including Alaska and Hawaii, but no eclipse will be visible near and along the Atlantic Seaboard.

June 4: Partial eclipse of the moon
This partial lunar eclipse favors the Pacific Ocean; Hawaii sees it high in the sky during the middle of its night. Across North America the eclipse takes place between midnight and dawn. The farther east one goes, the closer the time of moonset coincides with the moment that the moon enters the Earth's dark umbral shadow.

In fact, over the Northeastern United States and eastern Canada, the only evidence of this eclipse will be a slight shading on the moon's left edge (the faint penumbral shadow) before moonset. Over the Canadian Maritimes, the moon will set before the eclipse begins. At maximum, more than one-third of the moon's lower portion (37.6 percent) will be immersed in the umbra.

June 5: Rare transit of Venus across the sun
The passage of Venus in front of the sun is among the rarest of astronomical events, rarer even than the return of Halley's Comet every 76 years. Only six transits of Venus are known to have been observed by humans before: in 1639, 1761, 1769, 1874, 1882 and, most recently, in 2004.

The next one will occur in the year 2114. When Venus is in transit across the solar disk, the planet appears as a distinct, albeit tiny, round black spot with a diameter just 1/32nd of the sun. This size is large enough to readily perceive with the naked eye.?

HOWEVER ... prospective observers are warned to take special precautions (as with a solar eclipse) when attempting to view the silhouette of Venus against the blindingly brilliant solar disc.

The beginning of the transit will be visible from all of North America, Greenland, extreme northern and western portions of South America, Hawaii, northern and eastern portions of Asia including Japan, New Guinea, northern and eastern portions of Australia, and New Zealand. The end will be visible over Alaska, all of Asia and Indonesia, Australia, Eastern Europe, the eastern third of Africa, and the island nation of Madagascar.

Aug. 12: Perseid meteor shower
The Perseids are considered to be among the best of the annual displays thanks to its high rates of up to 90 per hour for a single observer, as well as its reliability. Beloved by summer campers and often discovered by city dwellers who might be spending time in the country under dark starry skies. [10 Perseid Meteor Shower Facts]

Last summer a bright moon wrecked the shower by blotting out many of the fainter streaks, but in 2012 the moon will be three days past last quarter phase on this peak morning ? a fat waning crescent presenting only a minor nuisance for prospective observers.

Nov. 13: Total eclipse of the sun
The first total solar eclipse since July 2010. Virtually the entire path of totality falls over water. At the very beginning, the track cuts through Australia's Northern Territory just to the east of Darwin, then across the Gulf of Carpentaria, then through northern Queensland, passing over Cairns and Port Douglas before heading out to sea.

The rest of the eclipse path, including the point of the maximum duration of totality (4 minutes, 2 seconds) is, unfortunately, pretty much wasted by falling over the open waters of the Pacific Ocean.

Dec. 13-14: Geminid meteor shower
If there is one meteor display guaranteed to put on a very entertaining show it is the Geminid meteor shower. Now considered by most meteor experts to be at the top of the list, surpassing in brilliance and reliability even the August Perseids.

Bundle warmly against the winter chill; you can start observing as soon as darkness falls on the evening of Dec. 13 as Gemini starts coming up above the eastern horizon and continue through the rest of the night. Around 2 a.m. when Gemini is almost directly overhead, you might see as many as two meteor sightings per minute ? 120 per hour! And the moon is new, meaning that it will not be a factor at all.

Dec. 25: Christmas evening and Jupiter
On Christmas, many will be looking skyward and wondering what that brilliant silvery "star" is hovering just above the waxing gibbous moon. It's not a star (or Santa returning to the North Pole), but the largest planet in our solar system, Jupiter, serving as a sort of holiday ornament with our nearest neighbor in space to cap off a year of interesting and predictable sky events that we all can enjoy!

Expedia touts verified hotel reviews

Travelers considering using Expedia.com to book a room at the three-star Circus Circus Hotel and Casino in Las Vegas will find rates starting at $44 and descriptive copy promising ?newly remodeled? rooms and ?world-class circus acts.?

Sounds fun. But under the ?Guest Reviews? tab, potential guests will also find two recent reviews calling the hotel ?not the best? and ?more like average average.?

Could those write-ups be the handiwork of a couple of clowns from the competition down the road?

Not likely. At least not anymore.

In a move designed to make better use of its growing database of millions of traveler-generated hotel reviews and assure users that its reviews are not faked ??an issue other sites are dealing with ? Expedia has rolled out a new hotel booking platform with a revamped ?Expedia Verified Reviews? program.

The enhanced program allows travelers to filter hotel searches in new ways (for example, by proximity to a sports stadium) and confirms that each review ? good or bad ??was written by an Expedia customer who actually booked and stayed at that hotel.

With a new review form that rolled out last week, Expedia is also gathering more information.

?We?re starting to collect interest information,? said John Kim, Expedia?s senior vice president of global products. ?We get a lot of requests for reviews that would be useful for people with dogs or for hotels that would be good for foodies. The new form we send out after a hotel stay allows customers to write reviews for a specific audience.?

The verification process may narrow the pool of reviewers, Kim said, ?but we can get high quality, narrow content that is useful because we have so many users.?

Sites such as TripAdvisor, recently spun off from Expedia, that allow user reviews was a transformational travel achievement, said Bjorn Hanson, divisional dean of New York University?s Preston Robert Tisch Center for Hospitality, Tourism, and Sports Management. ?Now the idea of verified reviews is a major enhancement,? he said.

Hanson notes that verifying a review doesn?t prevent unfair or unreasonable reviews, but ?it does prevent the work of unscrupulous competitors and consumers unhappy with a prior experience with that brand from posting a baseless review.

?It doesn?t make TripAdvisor look bad,? said Hanson. ?It makes Expedia look like it?s advancing the state of the art, which is a competitive advantage.??

Health Tip: Wear Your Seat Belt During Pregnancy (HealthDay)

(HealthDay News) -- Wearing a seat belt is particularly important during pregnancy, when you're protecting for two.

The American Academy of Family Physicians offers these suggestions for moms-to-be while traveling in the car:

  • Wear your seat belt properly, with the lap belt beneath your belly and the shoulder strap positioned between the breasts and to the side of the belly.
  • Move your seat back as far as possible if you have airbags. Tilt the seat to give your belly more space.
  • If you aren't driving, sit in the back seat.
  • Always see your doctor immediately after a car accident, even if you don't feel like you are hurt.

Consumer confidence index surges in December (AP)

NEW YORK ? Americans are gaining faith that the economy is on the upswing.

An improving job outlook helped the Consumer Confidence Index soar to the highest level since April and near a post-recession peak, according to a monthly survey by The Conference Board.

The second straight monthly surge coincided with a decent holiday shopping season for retailers, though stores had to heavily discount to attract shoppers.

The rise in confidence jibes with a better outlook for the overall economy. An Associated Press poll of three dozen private, corporate and academic economists projects U.S. economic growth will speed up in 2012, if it isn't derailed by upheavals in Europe.

But confidence is still far below where it is in a healthy economy. And Americans' mood could sour again if the debt crisis in Europe deepens and spreads to the U.S. Shoppers still face big obstacles ? higher costs on household basics and a still-slumping housing market.

"This is encouraging. It's good to be talking about improvement," said Mark Vitner, an economist at Wells Fargo. "But there is still a lot of room for trouble."

The Conference Board, a private research group, said Tuesday that its Consumer Confidence Index rose almost 10 points to 64.5 in December, up from a revised 55.2 in November. Analysts had expected 59. The level is close to the post-recession high of 72, reached in February.

The December surge builds on a big increase in November, when the index rose almost 15 points from October. That month's reading was the lowest since March 2009, the depths of the recession.

One component of the index that measures how shoppers feel now about the economy rose to 46.7 from 38.3 in November. The other barometer, which measures how shoppers feel about the next six months, rose to 76.4 from 66.4.

In particular, shoppers' assessment of the job market improved, according to preliminary results of the survey conducted Dec. 1-14. Those anticipating more jobs in the months ahead increased to 13.3 percent from 12.4 percent while those anticipating fewer jobs declined to 20.2 percent from 23.8 percent.

Economists watch confidence numbers closely because consumer spending ? including items like health care ? accounts for about 70 percent of U.S. economic activity.

Americans have more reason to be optimistic. The economy has produced at least 100,000 new jobs for five months in a row, the longest such streak since 2006. The number of people applying for unemployment benefits has dropped to the lowest level since April 2008.

According to the AP poll of economists, conducted Dec. 14-20, the U.S. economy is expected to grow 2.4 percent next year. In 2011, it likely grew less than 2 percent.

"We're starting to make some progress," said Kathy St. Louis of Atlanta, who was picking up lunch Tuesday at CNN Center. "It could always be better, but we're trying to move in the right direction." She said she spent $700 on holiday presents, up from the $300 she spent last year, even though not much changed with her paralegal job.

Ahlum Beruk, 22, a Greenville, Miss., resident who was visiting Atlanta, was a student last year and worried about finding a job. This year she works for a hotel and spent about $100 on Christmas presents. She spent nothing on gifts last year.

"I do feel better because I have a job now, and I didn't before," she added.

Shoppers still face many hurdles. In fact, while the job market is steadily improving, the unemployment rate is still high at 8.6 percent. And housing remains wobbly. The Standard & Poor's/Case-Shiller index of home prices, also released Tuesday, dropped in October in 19 of the 20 cities it tracks. It was a second straight declining month, further evidence of a bumpy housing recovery

Lynn Franco, director of The Conference Board Consumer Research Center, noted renewed fears about a second recession hurt confidence last summer.

"While consumers are ending the year in a somewhat more upbeat mood, it is too soon to tell if this is a rebound from earlier declines or a sustainable shift in attitudes," Franco said. "Have we rebounded from a summer lull or are we turning the corner?"

In fact, even with the increase in confidence, shoppers have been focused on deals this holiday season. Shoppers, enticed by expanded hours and bargains, packed stores for the start of the holiday season, resulting in discount-fueled record spending. But then they retreated for a few weeks to wait for better deals.

Based on the stronger-than expected start and rising optimism that more spending was to come in the finale, the National Retail Federation earlier this month upgraded its holiday sales growth forecast to 3.8 percent, from the original forecast of 2.8 percent made in September. More data will be released this week that will help quantify the last-minute sales surge.

Still unclear is how the discounting will affect stores' profit margins. It might not be all bad for retailers: Roxanne Meyer, a retail analyst at UBS Investment Research, says post-Christmas markdowns were not as deep as expected, with less than half of retailers she surveyed increasing promotions from last year.

Youth killed amid London sales shoppers

An 18-year-old man has been stabbed to death as thousands of bargain hunters thronged one of London's busiest shopping streets.

The 18-year-old from south London was killed in the Foot Locker store on Oxford Street as hundreds of thousands of people shopped nearby on the opening day of the post-Christmas sales.

Police said it was too early to establish what the motive for the stabbing was.

Ten arrests have been made and a crime scene has been set up.

A forensics team erected a white tent in front of Foot Locker, overlooked by Christmas lights.

Confused Boxing Day bargain hunters and tourists were coming up to the police cordon to take pictures and ask officers what had happened.

Shoppers could be seen going in and out of shops near the crime scene, but a number of stores were forced to close.

An employee at the nearby Disney Store said: 'We are being quite badly affected, we are unlikely to open again today.'

Police said they were called about 1.45pm (0045 AEDT on Tuesday) to reports of a stabbing.

London Air Ambulance and London Ambulance Service also attended but the man was pronounced dead at the scene.

A spokeswoman for the New West End Company, which represents local retail traders, declined to comment on the stabbing or the effect on retailers on one of the busiest shopping days of the year.

But earlier, the company reported STG15 million ($A23 million) sales in the first three hours of the Boxing Day sales despite a drivers' strike on the London Underground.

Jace Tyrrell of the New West End Company said: 'As ever, the West End's Boxing Day sales have attracted shoppers in their hundreds of thousands.'

Senior investigating officer Detective Chief Inspector Mark Dunne, from the Metropolitan Police's Homicide Command, later told reporters at the scene that the murder had taken place at the 'busiest place in the United Kingdom on the busiest shopping day'.

He said: 'A number of weapons have been recovered from that scene, whether I have got the murder weapon I don't know. There's an assortment of items but no guns.

'My officers and many other officers from the West End are looking to get as many witnesses as we possibly can and to get a full account of exactly why this happened.'

Dunne said it seemed that there had been a confrontation between two groups of youngsters and confirmed that 'a number of people' had been arrested.

'We are in the process of speaking to them and speaking to some witnesses who have already come forward.
