A federal judge canceled a scheduled June 11 trial between Apple Inc and Google Inc's Motorola Mobility unit over patents related to mobile phones and tablet computers, and expects to dismiss the case because neither can prove damages.
In a "tentative" order, US Circuit Judge Richard Posner in Chicago on Thursday said each company's case should be dismissed with prejudice, meaning it cannot be brought up again.
He said neither Apple nor Motorola Mobility had enough admissible evidence of damages to withstand dismissal.
Posner also said to grant injunctions against infringements "would impose costs disproportionate to the harm to the patentee and the benefit of the alleged infringement to the alleged infringer and would be contrary to the public interest."
The judge said he expects to more fully explain his reasoning in a written opinion within one week. Posner normally handles appeals, rather than cases in trial court.
"We are pleased by the Illinois trial court's tentative ruling today dismissing Apple's patent claims and look forward to receiving the full decision," Google said in a statement.
Apple declined to comment. The trial, which would have been before a jury, would have been the first between the companies since Google last month bought Motorola Mobility for $12.5 billion.
It is one of many lawsuits worldwide pitting Apple, whose iPhone is the world's most popular smartphone, against Motorola Mobility, whose parent produces the Android operating system.
In 2012, the iPhone is expected to capture more than 20 percent of the global smartphone market, while 61 percent of smartphones will use the Android system, International Data Corp said on Wednesday.
Apple had sued Motorola Mobility for alleged infringements of four patents, but a May 22 ruling by Posner scuttled its damages claims on two of those patents. Motorola Mobility had sued over one patent.
Apple is based in Cupertino, California, and Google is based in Mountain View, California.
The case is Apple Inc et al v. Motorola Inc et al, US District Court, Northern District of Illinois, No. 11-08540.

La Quinta, Calif., and Tempe, Ariz. In mid-2011, retired California chemist and entrepreneur Harry Lonsdale issued a challenge to the origin of life scientific community to come up with novel ideas for explaining the mechanism of life's origin, through the Origin of Life Challenge (http://originlife.org).
Dozens of proposals were received and evaluated by an international panel of experts. The winners were announced today by Lonsdale in collaboration with the Origins Project at Arizona State University and its director Lawrence Krauss (http://origins.asu.edu). Lonsdale is co-founder of the high tech company, Bend Research Inc., Bend, Ore., (http://www.bendresearch.com) and Krauss is an ASU Foundation Professor.
Unraveling life's origin won't be easy. Earth was a hellish place when life started some 3 to 4 billion years ago. It was a rocky planet with oceans and a primitive, oxygen-free atmosphere, subject to rampant volcanism and intense solar radiation, with frequent impacts from asteroids and comets. Yet, that was the cradle of life, and as far as we know the only life in the universe. Somehow life started and, through replication of its blueprint and the extraction of energy from its environment, life gained a toehold here on Earth, so that Darwinian evolution could begin its inexorable march toward us.
Co-winners of the $50,000 prize in response to the Origin of Life Challenge were two British chemists, John Sutherland at the Medical Research Council Laboratory in Molecular Biology, Cambridge, and Matthew Powner at University College, London. They also received a $150,000 one-year grant to pursue their research in the field.
The Sutherland-Powner team is focused on understanding the chemistry of the replication mechanism of first life. All biological replication is based on the nucleic acid polymers RNA and DNA, which carry the genetic code. The team seeks to demonstrate the selective generation of the RNA building blocks and other key biological molecules from simple feedstock molecules under the presumed environmental conditions of pre-biotic Earth. If successful, the Sutherland-Powner team will have demonstrated how RNA could have emerged from plausible chemical reactions on the early Earth.
A $90,000 one-year grant was also made to a joint Canadian-U.S. team consisting of Niles Lehman of Portland State University, Portland, Ore.; Peter Unrau of Simon Fraser University, Burnaby, British Columbia, Canada; and Paul Higgs of McMaster University, Hamilton, Ontario, Canada. That team will explore the ways in which potential information stored within random pieces of RNA can spontaneously assemble into sets of self-replicating molecules.
The Lehman-Unrau-Higgs team will mix large pools containing small fragments of non-functional RNA under a range of plausible pre-biotic conditions, looking for RNAs that have the ability to make copies of themselves, as well as catalyze other important biochemical reactions. If successful, they will have demonstrated the transition from "dead" chemicals to a living state of autonomous replication.
A third, $60,000 grant was made to the team of Wenonah Vercoutere of NASA Ames Research Center, Moffett Field, Calif., and David Deamer at the University of California, Santa Cruz. That team will attempt to demonstrate how simple molecules called nucleotides can polymerize to form RNA when they are organized within membranous structures and exposed to conditions simulating volcanic hot springs. If successful, they will have shown how proto-cells containing RNA could have been produced in the pre-biotic environment.
"These researchers are among the best in the world, and I am excited to see the results of their work," Lonsdale said. "Ultimately, it is my hope that within a decade or two the fruits of this research will help provide answers to the origin of life question, and that a rational model for life's origin will be taught in every biology classroom in the world."
Krauss said the Origin of Life Challenge grants fit perfectly into the mission of the Origins Project at ASU which is to ask the big questions. "The Origins Project is thrilled to partner with Harry Lonsdale to further his remarkable vision of pushing forward the frontiers of our understanding of life's origin," Krauss explained. "It is my hope that these awards will motivate others to contribute support for investigating the important foundational questions that drive the Origins Project and, more broadly, fundamental science everywhere."

CHICAGO (AP) - Brandon Morrow's previous start was a painful one. He took a line drive off his leg and had to be helped off the field.
A week later, he hopped back on the mound and showed no adverse effects.
Morrow pitched a two-hitter for his third shutout this season, most in the majors, and the Toronto Blue Jays got home runs from Jose Bautista and Rajai Davis in a 4-0 victory over the Chicago White Sox on Wednesday night.
"It felt fine for a few days. It's just sore to the touch. It doesn't hurt to move. There was no hesitation," Morrow said about his leg.
Against Baltimore a week earlier, Morrow took a liner off the bat of Wilson Betemit in the seventh inning. After X-rays showed no major injury, it was determined it was just a bruised right shin. And the right-hander wasn't worried Wednesday night about another hard-hit ball coming at him through the box.
"There's that chance every time you take the mound. That's not something you think of. If it happens, it happens," he said. "I've been hit a few times."
Morrow (7-3) allowed singles in the second and eighth to A.J. Pierzynski and retired 14 straight at one point. He gave up his only two walks in the ninth, to Adam Dunn and Alejandro De Aza, and struck out five, including Dayan Viciedo to end it.
"It was mainly all fastball, slider. I threw a few changeups to the left-handers, trying to keep them honest," Morrow said. "When I have fastball command down to both sides of the plate, that's when I've been at my best, and that's what I had tonight."
He faced a White Sox lineup without star Paul Konerko, who sat out a second straight game after having a bone chip flushed out of a joint in his left wrist. Chicago's first baseman has missed three games in a row overall after having the day off to rest last Sunday. Konerko said he hopes to play Thursday night when the White Sox try to avoid a three-game sweep.
"It's just one of those days when you run into a guy that puts it to you and just overmatches you," Chicago manager Robin Ventura said of Morrow's performance, one that followed a strong effort Tuesday night by Ricky Romero in the Blue Jays' 9-5 win.
After the two losses, Chicago's lead in the AL Central has been trimmed to a half-game over Cleveland.
"Guys throw like that, like the last two nights, and it's tougher. It's just the way it goes," Ventura said. "You just put it behind you."
After Pierzynski's second single in the eighth and with the White Sox down 2-0, pinch-runner Brent Lillibridge was easily thrown out trying to steal second with no outs.
"It kills their rally there," Blue Jays catcher J.P. Arencibia said. "I was fortunate to get a good pitch to throw on. Right out of the hand I knew I had a good throw on the way. It was a big out."
Chicago starter Jose Quintana (1-1) gave up nine hits and two runs in six innings. He was making his first start since being ejected in the fourth inning against the Rays a week ago for throwing behind Ben Zobrist.
Quintana has pitched well while filling in for John Danks, on the disabled list with a strained shoulder.
"He's proved he can pitch up here," Ventura said.
The Blue Jays snapped a scoreless tie in the fifth when Davis just beat a throw to first as the White Sox were trying to turn a double play. He stole second and scored when Colby Rasmus - who was 5 for 5 in the series opener- lined an RBI single to left before being thrown out trying to stretch it to a double.
Leading off the sixth, Bautista hit a 3-2 pitch halfway up the left-field bleachers for his 15th homer of the season to give Morrow a two-run cushion. Davis added a two-run shot in the ninth, his fourth of the season, off Hector Santiago.
NOTES: Chicago backup catcher Tyler Flowers replaced Konerko at first. Flowers started two games there last season. ... Danks threw a pain-free bullpen session of 30-40 pitches and said he'll probably pitch one rehab game next week before coming off the DL and returning to the rotation. ... Blue Jays DH Edwin Encarnacion (right wrist) remained out of the lineup for the second consecutive game. He was hit in the wrist by a pitch Sunday. ... Yan Gomes was recalled from Triple-A Las Vegas and put in the lineup at first base. It is his second stint with Toronto this season. He was robbed of a hit in the second inning on a diving stab by White Sox third baseman Orlando Hudson.
